EU Targets Elon Musk’s X with Potential $1 Billion+ Fine Over Regulatory Breaches

The European Union is making plans to fine Elon Musk’s X (popularly referred to as Twitter in the past) for more than $1 billion. As the Spokesman and Bitcoin.com reported, the European Union started an investigation into the company due to the alleged violation of the key provisions of the new Digital Services Act.
Introduced in 2024, the DSA targets the biggest online platforms. It asks for stricter content moderation, transparency, and better user protection, especially concerning illegal content and fake news. Its officials have said that imposing a revenue cap is not an option for Brussels, stressing the number of misses and infringements X has already collected.
What’s the Issue?
Since Elon Musk took over the platform in late 2022, critics say X has taken a more hands-off approach to content moderation. That shift has triggered concerns in Europe, where strict rules apply to “very large online platforms” (VLOPs) under the DSA.
The European Commission launched a formal investigation into Elon Musk’s X in December 2023. That inquiry is reportedly focused on several major issues:
Spreading Disinformation: X is accused of not doing enough to stop the spread of political misinformation and false health-related claims.
Lack of Transparency: Regulators claim the platform hasn’t been clear about how its algorithms promote content, which directly violates DSA transparency rules.
Poor User Protection Tools: X allegedly doesn’t have reliable systems for users to flag or resolve harmful or illegal content.
If the Commission concludes that these violations are valid, X could be fined up to 6% of its global revenue. The platform’s size could mean a penalty north of $1 billion, the largest ever under the DSA.
A Wake-Up Call for Big Tech
This isn’t just about X. EU officials see this case as a test of the DSA’s power — and a message to all tech giants operating in Europe.
Thierry Breton, the EU’s Commissioner for the Internal Market, has been outspoken about enforcing the DSA. “We will not tolerate platforms that ignore our rules,” he warned earlier this year. “The DSA gives us the power to act decisively — and we will use it.”
Musk Pushes Back
Elon Musk hasn’t taken the criticism lying down. He’s repeatedly defended X’s policies in the name of free speech and has accused the EU of trying to censor voices they don’t agree with. In past comments, Musk hinted that the bloc’s efforts might be politically motivated.
But legal experts say that’s not the point. According to them, the DSA isn’t about silencing opinions — it’s about ensuring platforms are accountable for their systems’ operations and what kind of harm they may cause.

The fine hasn’t been officially announced yet, but insiders say the EU’s case is in its final stages. A formal decision could come within the next few weeks.
